The organizer of the Competition is Freaks 4U Gaming GmbH (“organizer”), An der Spreeschanze 10, 13599 Berlin. Participation in the Competition implies the participant’s agreement to these terms and conditions of participation. By participating in the Competition, the participant accepts these conditions of participation. 

 

 1. Eligibility of participants 

1.1. Anyone who has a permanent residence of countries part of Europe (incl. the United Kingdom, excl. Ukraine and Russia) and is at least 16 years old can participate in the Competition.

1.2. Employees of the organizer and other companies entrusted with the implementation of the campaign, as well as their relatives, are excluded from participation. 

1.3. It is a condition of participation that all information provided by a participant in the context of the Competition is true. This applies in particular with regard to personal details.

1.4. The organizer reserves the right, upon its sole discretion, to exclude participants on valid grounds, such as but not limited to: 

  • Violations of the rules and conditions of participation in the Competition 
  • Manipulation of the technical process or administration of this Competition 
  • Undue conduct 
  • False or misleading statements regarding participation in this Competition. 

2.Procedure of contest 

2.1. Participation in the Competition can only take place via the following channels/websites: Instagram: https://www.instagram.com/evnia 

2.2. To participate, the participant must complete the tasks as stated. Mandatory tasks are to follow evnia and teamvitality Instagram accounts and add the comment to the post with giveaway description from the same Instagram account. 

 

 

3. Contest period 

3.1. The Competition starts on the 16.02.2024 at 5:00 PM at and ends on the 29.02.2024 at 4:00 PM (the “Competition Period”). Any attempts to enter the Competition outside of the Competition period is invalid.  

3.2. Only entries that are complete, legible, correctly addressed, and submitted during the Competition Period will be entered into the Competition. The organizer accepts no responsibility for entries that are lost, late, incomplete, never received, or never entered for technical or any other reason. 

 

4. Prizes 

4.1. The following prizes will be drawn from among all valid entries: 

Prize 1-2: „1x Philips Evnia 25M2N3200W & 1x Philips Evnia 25M2N3200W “
Prize 3-4: „1x Vitality Veste Bomber Vegas & 1x Vitality Veste Bomber Tokyo“ 

Prize 5-6: „2x Love Vitality Mug 2x Vitality Bottle 2x Vitality Pin“ 

 

4.2. The prize may not be transferred, substituted, or redeemed for cash or otherwise.  

4.3. The organizer reserves the right, at its sole discretion, to award another prize of equal or greater value. The value of the prize is at the sole and absolute discretion of Freaks 4U. 

4.4. Legal action is excluded.  

 

5. Announcement of the winners  

5.1. Winners will be notified on 29.02.2024 by Instagram private message and announced on social media channels https://www.instagram.com/evnia/. 

5.2. The winner must contact the organizer within 72 hours of the announcement of the prize to clarify the data required for sending or handing over the prize. If no response is received within 72 hours or if the winner is disqualified for any other reason, his/her entitlement to the prize will lapse. In this case, the organiser reserves the right to select a new winner. 

 

 

6. No purchase requirements 

There is no requirement for the purchase of any good or service offered by the organizer, or any third company affiliated with either of the aforementioned and/or any of their business partners. Purchase of any such good or service does not increase the participant’s chances in this Competition. 

 

7. Data protection 

The personal data of all participants will only be used for the purpose of conducting and administering the Competition. The organizer will use personal data to administer the entry into the Competition. By entering this Competition, entrants agree to the organizer using the data provided by entrants for this Competition. After the end of the competition, the organizer will delete the participants’ data. 8. Liability 

8.1. The organizer is not liable for damages that may be caused by errors, delays or interruptions in transmission, malfunctions of technical equipment and the service, incorrect content, loss or deletion of data, viruses, or in any other way during participation, unless such damages are caused by the organizer or its various agents intentionally, through gross negligence or through the breach of essential contractual obligations (those whose fulfilment characterizes the contract and on which the participant may rely). Liability for damages caused by negligence is limited to the amount of damages foreseeable at the time of conclusion of the contract and typical for the contract.  

8.2. Not covered by this exclusion or limitation of liability are damages resulting from injury to life, body, or health. 

8.3. The organizer is not liable for the insolvency of a cooperation partner and the resulting consequences for the implementation and handling of the competition. 

 

9. Indemnification 

The participants indemnify the organizer against all claims of third parties that have arisen due to the content provided to the participants. They agree to assist the Organiser in any reasonable way in defending against such claims. 

 

10. Reservation 

The organizer reserves the right to cancel or terminate the Competition at any time without prior notice and without stating reasons if for technical reasons (e.g., viruses in the computer system, manipulation, or errors in the hardware and/or software) or for legal reasons or for other reasons a proper implementation of the promotion cannot (or can no longer) be guaranteed. 

 

 

11. Choice of law 

The law of the Federal Republic of Germany shall apply. This choice of law shall apply to consumers only to the extent that they are not thereby deprived of the protection afforded to them by mandatory provisions of the law of the state in which they have their habitual residence. 

 

12. Severability clause 

Should any provision of these Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these Conditions of Participation. In place of the invalid provision, the legally permissible provision that comes closest in economic terms to the meaning and purpose expressed in the invalid provision shall apply. The same shall apply in the event of a loophole in these Conditions of Participation.
